In addition, it also states "only “Let’s Plays, Game Music Covers, and Fan Art” are allowed."

 

Also, it says for Non-Commercial use. As covered in the OP some people consider contests to be commercial, so you would actually have to contact Nintendo for this specific matter.

I highly doubt Nintendo would allow you to use their music in a game that could be considered commercial, for a contest with actual prizes.

 

As for Yaht Club Games, I would like to see that email somehow, and you would need to make sure that it covers commercial usage, in which case sure go ahead.

@Kirimash: Referencing is fine I think, but sprites are entirely dependant on permissions (so if you used Nintendo sprites, then no since this is a commercial contest)

 

@Jackus: Just bought a couple games for the prize draw~

Yes, basically.

This was discussed for a bit, and I think that the conclusion was that if it's just a subtle reference (and uses original resources, not ripped ones), it's fine. But if you are trying to directly reference a character (or other distinct things from a work), it might fall into copyright. To be safe, I'd recommend not trying to include cameos of characters or glaringly obvious direct references from other commercial copyrighted works (without permission, of course).

 

Although some other works (even commercial ones) do a bit of copyright avoidance to include an innocuous reference (such as replacing a letter from a popular brand to represent the brand, but technically it is not the brand), it is still risky sometimes.

 

Indeed, perhaps they may not sue you due to the insignificance of the work (doesn't gain significant profit or steal away attention from the actual copyrighted product), but it's better to be safe. It's also a good practice, especially in the case of creating/releasing games.

 

And besides, if there is an obvious potential copyright infringement that we/the judges/Jackus spot in your game, it will be up for disqualification.

If anything, I'd suggest to exercise originality/independence in the game that you will make.

I don't know what you mean by neutral song, but if it is mentioned that you are permitted to use said song in a game project (and in commercial usage, to be safe) then it is allowed.

Again, it's about permission.
